Texas Tough Rentals, LLC

These Terms and Conditions ("Terms") govern the use of the Texas Tough Rentals, LLC website and the rental of equipment through it. By accessing this website, submitting a booking request, or renting equipment, you agree to be bound by these Terms.
If you do not agree, do not use this website or rent equipment.
1. Company Information
Texas Tough Rentals, LLC ("Lessor," "we," "us") is engaged in the business of renting dump trailers and related equipment.
2. Equipment Description
The primary equipment available for rent includes, but is not limited to:
- Make/Model: Diamond C LPT207
- Year: 2024
- Type: Dump Trailer
- Rated Capacity: 9,500 lbs
- VIN: 46UFU142XR1283991
Specific equipment details may be confirmed at pickup or delivery.
3. Rental Agreement Incorporation
All rentals are governed by these Terms and a separate Dump Trailer Rental Agreement. In the event of a conflict, the signed Rental Agreement controls.
4. Booking & Rental Period
- Rental periods begin and end on the dates confirmed at checkout or in writing.
- Equipment must be returned by 5:00 PM on the End Date, unless otherwise approved in writing.
- Extensions require prior written approval. Unauthorized extensions will be billed at the maximum daily rate.
5. Fees, Payments & Deposits
- Rental fees are payable in advance via approved electronic payment methods.
- A $250 initial security deposit is required. The deposit is fully refundable once the trailer is returned with no damage.
- Late returns, damage, cleaning, misuse, or policy violations will be deducted from the deposit.
- If costs exceed the deposit, the Lessee remains fully liable.
6. Delivery & Pickup
- Pickup occurs at the Lessor's designated location unless delivery is purchased.
- Lessee is responsible for safe transport, towing compatibility, and load security.
- Lessee must inspect equipment at pickup and accept its condition.
7. Permitted Use
The Lessee agrees to:
- Use the equipment legally and safely
- Follow all operating instructions
- Never exceed the 9,500 lb capacity
- Never sublease, lend, or transfer the equipment
Prohibited use includes:
Illegal activity, reckless operation, off-road abuse, overloading, or modification.
8. Maintenance & Repairs
- Routine checks (tires, load security, hydraulic operation) are the Lessee's responsibility.
- Damage caused by misuse, neglect, or improper towing will be charged in full.
- Do not attempt unauthorized repairs.
9. AS-IS / No Warranties
All equipment is rented AS IS.
We make no warranties, express or implied, including merchantability or fitness for a particular purpose. We are not liable for downtime, delays, or losses caused by equipment failure.
10. Loss, Theft & Damage
Lessee assumes all risk from pickup to return.
Lessee is responsible for:
- Theft
- Vandalism
- Accidents
- Total loss
Replacement costs are based on full market value, not depreciated value.
11. Ownership
All equipment remains the sole property of Texas Tough Rentals, LLC.
Removing labels, GPS devices, or identifying marks is strictly prohibited.
12. Insurance Requirement
Before taking possession, Lessee must maintain:
- General liability insurance
- Property damage coverage
- Auto/trailer liability (if towing)
Failure to maintain coverage does not limit Lessee's liability.
13. Taxes
All applicable Texas sales, use, and rental taxes are the responsibility of the Lessee unless a valid exemption certificate is provided before the rental begins.
14. Indemnification
Lessee agrees to indemnify and hold harmless Texas Tough Rentals, LLC from all claims, damages, injuries, losses, or legal fees arising from use or possession of the equipment.
15. Default
Default includes, but is not limited to:
- Non-payment
- Late return
- Unauthorized use
- Failure to return equipment
Upon default, we may immediately repossess the equipment and pursue all legal remedies.
16. Remedies
We reserve the right to:
- Terminate the rental
- Repossess equipment without notice
- Retain deposits
- Charge additional fees
- Pursue legal action
17. Assignment
You may not assign or sublease the equipment. Any attempt is void.
18. GPS Tracking Disclosure
All trailers are equipped with GPS tracking for theft prevention, recovery, and contract enforcement. By renting, you explicitly consent to this tracking.
19. Website Use
You agree not to:
- Misuse the website
- Submit false booking information
- Attempt fraud or chargebacks without cause
We may refuse service at our sole discretion.
20. Limitation of Liability
To the maximum extent permitted by law, Texas Tough Rentals, LLC shall not be liable for indirect, incidental, or consequential damages.
21. Governing Law & Venue
These Terms are governed by the laws of the State of Texas.
Venue shall lie exclusively in the county of Lessor's principal office.
22. Severability
If any provision is unenforceable, the remainder remains in full effect.
23. Entire Agreement
These Terms, together with the Rental Agreement, constitute the entire agreement between the parties.
24. Acceptance
By using this website, submitting a booking, or renting equipment, you confirm that:
- You have read and understood these Terms
- You agree to be legally bound
- You had the opportunity to consult legal counsel
